All work we produce, and any contracts we enter into, will be under the following terms and conditions [unless otherwise agreed in writing]. We do adhere to these terms, so as to protect all involved parties, and trust that you will do the same :
Payment
Full website build
1] We require a deposit payment of 35% of the contract sum [according to our quotation] before any works can commence. This payment has been introduced to protect the initial design work that is carried out at the start of a website build project.
2] Once the project is 75% complete [according to us], we shall require another 35% payment to cover works until launch.
3] Only after the website is launched, and all services are confirmed operational, will we require the remaining 30% of to contract sum.
Additional works
A quotation will be given for all additional works. For existing clients, general additional works works will be completed before any monies are required - upon completion, 100% of the contract sum will be required.
Title
Web site
All work we carry out is based on long term partnership with our clients, therefore title to all visible entities through a web browser [html / images etc] will be handed over to the client on receipt of full payment of the contract sum. You can take these items to any other supplier as you see fit.
All titles relating to scripts designed by us to allow the generation of website pages, and master files used for image creation, will remain with us unless otherwise agreed in writing. These items are not for use by any other company than n-code web design.
All content, either text or images, is considered supplied by you. If you choose to add content that you don't have intellectual property rights for, we cannot be held responsible.
Databases
The title to all data stored in databases that you require us to create, populate or manage will be handed over to the client on receipt of full payment of the contract sum.
These items must be covered by your data protection / copyright notifications.
Domain names
If you purchase your own domain name, we are happy to administer that name for the period it is required. This procedure does not affect your contract with your domain name registrar. The only fee we charge is to carry out an monitor DNS settings.
If you require us to acquire a domain name for use with your website, again we are happy to do so. All we ask is that you pay the registration fee [at present £5 for .co.uk / £10 for .com], and the name will be registered to us. The only other fee we charge is to configure and monitor DNS settings. At no time do you carry any responsibility / title for the domain name.
Guarantee
Design
Each and every site we produce comes with our satisfaction guarantee - if you are not happy with the design / layout / usability of the site, we will continue to work on it until you are. If you feel that after all we are not the web design company for you, then we shall refund all money paid for the design work. To our knowledge, no other web design firm has this guarantee.
If you request / agree to launch the web site, then we shall assume that you have approved the design - therefore, any further alterations to the design will be chargeable.
Web hosting
If you have your website hosted with us, then we will provide you with the 99% uptime guarantee submitted to us by our providers. This means that your website will be accessible, via the internet, 99% of the time. Genuinely, this percentage is far greater, but as all systems involve physical hardware, it cannot be considered infallible.

"If we fail to reach any guarantee, we shall refund all monies paid for the product. Simple."
Cancellation
Design
If we have commenced design work following receipt of the deposit, you can cancel any further works by writing to us - you do not need to disclose a reason.
Please be aware that all monies paid will not be refunded, unless otherwise agreed in writing.
Web hosting
If you have your website hosted with us, then you can choose to cancel this contract with one months notification - again, you do not need to disclose a reason.
Annual hosting accounts will be refunded on a pro-rata basis, less £45 initial set up fee.
Non payment
If you default on any payment we have requested [according to the points above] we reserve the right to cancel all services with immediate effect.
If you wish to reinstate services following cancellation by us, you will be subject to relaunch costs [currently £165] unless otherwise agreed in writing.
Please be aware that we reserve the right to refuse to carry out any work without any explanation.
Each and every page we host will carry a link back to our website for your customer's peace of mind.
